1. Acceptance of Terms
By accessing and using the Chatabs platform provided by Conglorean Datalabs & Media Pvt Ltd ("Company", "we", "us", or "our"), you ("User", "you", or "your") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our services.
2. Service Description
Chatabs is an AI-powered WhatsApp Business API and RCS platform that enables businesses to communicate with customers through WhatsApp messaging, RCS, cloud telephony, and voice calling. Our services include but are not limited to:
- WhatsApp Business API access and management
- AI-powered chatbots and automation
- RCS messaging capabilities
- Cloud telephony and voice calling
- CRM and customer journey tracking
- Integration with Meta Click-to-WhatsApp Ads
3. Payment Terms
3.1 Payment Schedule: 100% payment must be made in advance to launch the WhatsApp Business API platform.
3.2 Pricing: Current pricing is available on our pricing page and may be subject to change based on Meta policies without prior notice.
3.3 Refunds: All payments are non-refundable once services have been activated, except as required by applicable law.
4. Contract Duration and Termination
4.1 Minimum Contract Period: Services are subject to minimum contract durations as specified in your chosen plan (Basic: 12 months, Pro: 6 months, Advance: 3 months).
4.2 Termination: Either party may terminate this agreement with 30 days written notice after the minimum contract period has been fulfilled.
5. User Responsibilities
Users must:
- Comply with all Meta (WhatsApp) policies and guidelines
- Provide accurate and complete information during registration
- Maintain the security of their account credentials
- Use the service only for lawful business purposes
- Not engage in spam, harassment, or any prohibited activities
- Provide necessary KYC documents for WhatsApp Business API approval
6. Platform Availability and Support
6.1 Service Availability: We strive to maintain 99.9% uptime but do not guarantee uninterrupted service.
6.2 Support: Technical support is provided during business hours (9 AM - 6 PM IST) for all plans, with 24/7 support available for Enterprise clients.
7. Data Privacy and Security
We are committed to protecting your data privacy and security. Please refer to our Privacy Policy for detailed information on how we collect, use, and protect your data.
8. Limitation of Liability
To the maximum extent permitted by law, Conglorean Datalabs & Media Pvt Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use.
9. Intellectual Property
All content, features, and functionality of the Chatabs platform are owned by Conglorean Datalabs & Media Pvt Ltd and are protected by copyright, trademark, and other intellectual property laws.
10. Modifications to Terms
We reserve the right to modify these Terms at any time. Users will be notified of significant changes, and continued use of the service constitutes acceptance of the modified Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.
